Terms and Conditions

1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

2. Entry is open to all Australian residents. Directors, employees and their immediate families of The Promoter (including spouse, parent, child or sibling whether or not they live in the same house) and printers, suppliers, providers and agencies associated with this promotion are not eligible to enter. Entry is open to consumers of all ages however If a winner is under 18 years of age the prize will be awarded to the winner’s parent or legal guardian.

3. The promotion commences on 1 June 2008 at 00:01am (AEST) and concludes on 29 June 2008 at 23:59pm (AEST). (“Promotion Period”)

4. To be eligible to enter the competition, you will be required to purchase a participating Red Nose Day car magnet, then submit your entry using one of the following entry mechanics:

(a) SMS: Send a SMS text message to 1979 8888 along with your full name, address, postcode and the last 5 digits of the barcode from the car magnet you have purchased, OR

(b) Visit www.rednoseday.com.au, and follow the links to complete the online entry form, including but not limited to, your full name, address and the last 5 digits of the barcode from the car magnet you have purchased

In both instances, so that the entry is received during the Promotion Period.

5. Major Prize: The first valid entry drawn from all valid entries received will win $2,500 of United Petroleum fuel cards (incl. GST). See United Petroleum’s website at www.unitedpetroleum.com.au for terms & conditions of use of the Prepaid fuel card.

6. Weekly State prize: The first valid winner drawn from each state group (NSW, ACT, VIC/TAS, SA, QLD/NT, WA) will receive a $100 United Petroleum fuel card (incl. GST). See United Petroleum’s website at www.unitedpetroleum.com.au for terms & conditions of use of the Prepaid fuel card. The weekly draws will take place from entries received between 1/6 – 4/6 (Draw 1), 5/6 – 11/6 (Draw 2), 12/6 – 18/6 (Draw 3) and 19/6 - 25/6/2008 (Draw 4) only. Entries received during each week will not roll over into any subsequent weekly draws. The prize pool for weekly prizes in each state group is valued at $400.

7. Total prize pool is valued at $4,900 including GST.

8. SMS entries charged at 55c including GST. SMS entries via the internet or computer systems are not valid and will not be accepted. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard.

9. Consumers may enter a maximum of 5 entries per day providing they have purchased a Red Nose Day Car magnet made during the Promotion Period for each entry they have submitted.

10. Entrants may be required to provide their proof of purchase for all valid entries received throughout the promotional period (in the form of photocopy of an original receipt or product barcode) in order to participate in the weekly/ major draw or claim a prize.

11. The major winner and weekly winners will be required to provide proof of purchase (in the form of an original receipt or product barcode) in order to claim a prize. The Promoter reserves the right to request each winner to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

12. The Promoter reserves the right to verify the validity of entries/prize claims and to disqualify any entrant who tampers with the entry process, or who submits an entry/prize claim which is not in accordance with these Conditions of Entry. This includes, but not limited, to entrants and households using multiple email address, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases.

13. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, inaudible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost or late entries.

14. The major and weekly prize draws will take place at 2:00pm at belong, Level 8, 155 George Street, Sydney, NSW 2000. Weekly draws will be conducted on 5th June, 08, (Draw 1),12thJune 2008 (Draw 2) 19th June 2008 (Draw 3) and 26th June 2008 (Draw 4) from the valid entries received as outlined in Condition 6. The major winner will be drawn on 30th June 2008.

15. All winners will be notified by mail and the major winner’s name and postcode will be published in the public notices section of The Australian Newspaper on 9th July 2008.

16. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value subject to any written directions from the relevant state lottery Departments

17. The prize must be taken as offered and cannot be varied. The prize value includes GST and is in Australian dollars and is the recommended retail value as provided by the supplier and is correct at time of printing. The Promoter accepts no responsibility for any variation in prize value.

18. Should any of the prizes remain unclaimed 3.5 months after the original major draw date, the Promoter reserves the right to conduct an unclaimed prize draw. The draw will take place on 16th October 2008 at the same time and place as the original draw subject to Reg 37 of the Lotteries and Gaming Act 1993 (SA). In the event of any winners, their name and postcode will be published in the public notices section of The Australian newspaper on 23rd October 2008.

19. The Promoter’s decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.

20. The Promoter and its associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

21. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.

22. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures.

23. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

24. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made. To facilitate your participation, the Promoter may disclose your personal information to other companies associated with this promotion. If you do not provide your personal information, the Promoter will not be able to enter you into this promotion. By entering this promotion unless otherwise advised, each entrant also agrees that the promoter may use this information in any media for future promotional, marketing and publicity purposes (including advising you of special sales, specific promotional events and other special offers) without any further reference, payment, or other compensation to the entrant including, sending the entrant electronic messages. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.

25. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.

26. The Promoter is not responsible for any technical malfunction of any telephone network or lines, servers or providers, technical problems or any combination thereof, or any other technical failures.

27. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation.
